Things to Keep in Mind

Here are a few reminders as you are making decisions about your benefit elections:

  • Full-time employees are eligible for benefits on their start date.  You will have 30 days from the start date to make your benefit elections. 

  • New employees that elect to cover a spouse on their health insurance must complete a Spousal Affidavit Questionnaire during enrollment on the Employee Benefits Enrollment Portal.

We offer 24/7 Textcare to all employees. Clinics and Pharmacies are available to all employees. Employees and dependents on our medical plan are eligible for free generic prescriptions through our pharmacy.

Leave of Absence

About the Family and Medical Leave Act

Under the Family and Medical Leave Act (FMLA), if you have worked at least one year and at least 1,250 hours in the past 12 months you are eligible for up to 12 weeks unpaid leave for the following circumstances:

  • Birth of a child; adoption of a child or the placement of a foster child
  • To care for a spouse, child or parent with a serious health condition
  • Serious health condition which makes the employee unable to perform the functions of the position
  • Active Duty Family Leave
  • Injured Service Member Leave

If you have a spouse, parent, or child who has been called to or in on active duty in the Armed Forces, you may be eligible for up to 12 weeks of FMLA in certain circumstances. If you are the spouse, parent, child or next of kin of a service member who was injured in the line of duty, you may be eligible for up to 26 weeks of FMLA leave.

While on FMLA, you are entitled to receive health benefits as if you were still working. Please contact the Benefits Department at (423) 498-7068 for information.

Special rules apply to instructional employees which affect the taking of intermittent leave or leave on a reduced schedule, or return from a leave near the end of an academic term (semester).

About Returning to Work

Return to Work Form

When returning to work, a physician release statement is required. You may be reinstated to the same or an equivalent position. Equivalent position is defined as a position having the same pay, benefits, working conditions, and substantially similar duties and responsibilities and entails substantially equivalent skill, effort, responsibility and authority. Note: If you go into unpaid status, your salary will be adjusted upon your return.

If you do not return to work following FMLA leave (for a reason other than the same condition, recurrence, or onset of a serious health condition that would entitle you to FMLA leave or other circumstances beyond your control), you may be required to reimburse HCDE for its share of health insurance premiums paid on your behalf during your FMLA leave.

About Your Benefits While on LOA

If you are on a Leave of Absence and continue to be paid through accumulated Sick Leave during your entire absence, your payroll deductions for your Employee Benefit Elections (such as health insurance, vision insurance, etc.) will continue to be deducted from your paycheck. 

If you are on a Leave of Absence and exhaust all accumulated paid leave, but are on Family Medical Leave for the duration of your absence, you will be responsible for paying your benefit premiums. If you fail to pay the premiums, your coverage will end. 

If you are on an Extended Unpaid Leave of Absence that does not qualify for, or exhausts your FMLA eligibility, you will be dropped from all Employee Benefit Elections on the last day of the month that your Unpaid Leave began. You will receive a COBRA election notice at your home address and you may reinstate your benefits by paying the full cost as indicated on your COBRA election form.

Qualifying Life Events 

A life event can affect your benefits and you are required to notify the Benefits Department in 30 days of the event to make changes to your benefits.

Examples of life status events:

  • Marriage
  • Divorce
  • Legal Separation
  • Birth of a child
  • Adoption of a child
  • Death
  • Loss of coverage

Employees must provide documentation to make changes to benefits for a qualifying life event.

HIPAA Privacy Practices

Effective April 14, 2003, the Hamilton County Department of Education is required to provide notice to all employees of our practices to maintain the privacy of each employee’s personal health information as required by Federal legislation under the Health Insurance Portability and Accountability Act (HIPAA). This notice will inform you of our legal obligations under HIPAA and will advise you of your rights concerning your medical coverage information.

This legislation also requires that we have an authorization on file, from you, prior to releasing any protected information to outside parties. COBRA

The Consolidated Omnibus Budget Reconciliation Act



What is COBRA?

A Federal Law – in 1986 Congress passed the Consolidated Omnibus Budget Reconciliation Act to require most group health plans to offer temporary continuation of group health benefits to employees and their eligible dependents, under certain circumstances, beyond the date they would no longer be eligible for the health benefits.

Who is eligible for COBRA?
Employees and their qualifying dependents who loose their group medical coverage due to termination of employment, reduction in hours, divorce, death, dependent reaching limiting age, Medicare entitlement or retirement.

When does coverage under COBRA begin?
Coverage begins on the date your coverage would otherwise have ended because of the qualifying event.

How long does coverage under COBRA last?
You may elect COBRA coverage for up to 18 months if you lost coverage due to termination of employment for any reason, other than gross misconduct, or if your work hours are reduced below the minimum eligibility requirements.

You may elect COBRA coverage for up to 29 months if you are considered disabled under Title II or Title XVI of the Social Security Act (within 60 days of the qualifying event) when coverage is lost.

COBRA coverage may be elected for up to 36 months by your covered children who have reached the limiting age or who no longer qualify as an eligible dependent under the group medical policy; by surviving covered spouse/children if you die, by a divorced spouse and/or dependent children whose coverage is affected due to the divorce. Newborns or adopted children may be added during a period of COBRA coverage but this event does not necessarily extend the original COBRA period.

When must I apply for COBRA?
Within 60 days of the date a qualifying event occurs, or within 60 days of the date you are notified of your rights to elect COBRA coverage, whichever is later.

When does COBRA coverage end?
COBRA coverage ends when any of the following events occur:

  • At the end of the applicable 18, 29 or 36 month eligibility period
  • If you or your dependents stop paying the required premium
  • If you or your dependents become eligible for Medicare
  • If you or your dependents become enrolled in another medical plan by reason of employment or marriage and satisfy the pre-existing limitations imposed by the new medical plan.
  • If you or your dependents are no longer considered disabled for Social Security purposes.
  • If all health plans provided by your employer are discontinued.

How much does COBRA coverage cost?
If you elect COBRA coverage, the employer may charge no more than 102% of the group rate (for insured plans) and no more than 102% of the previous year’s cost for self-insured plans. Payments must be made timely (within 30 days of the due date)

How do I apply for COBRA?
It is your responsibility to notify your employer within 30 days in the event of divorce, legal separation, and eligibility for Medicare or any change of status of your dependents.

When an employee dies, is terminated or their work hours are reduced, the employer has 30 days to notify the Plan Administrator. Within 14 days of receiving notice the Plan Administrator must notify the employee and dependents of their COBRA continuation rights. The employee and/or their dependents then have 60 days to elect COBRA.

This notice below has information about your current prescription drug coverage with the Hamilton County Department of Education and about your options under Medicare’s prescription drug coverage. This information can help you decide whether or not you want to join a Medicare plan. If you are considering joining, you should compare your current coverage, including which drugs are covered at what cost, with the coverage and costs of the plans offering Medicare prescription drug coverage in your area. Information about where you can get help to make decisions about your prescription drug coverage is at the end of the notice.
